Como se diz isso em inglês: "O acolhimento de recurso importará na invalidação apenas dos **atos, insuscetíveis de aproveitamento**."

The grant of the appeal results in the invalidation only of ACTS THAT
COULD NOT BE OTHERWISE USED; ACTS THAT COULD NOT BE CONFIRMED; ACTS
THAT COULD NOT BE RATIFIED; INVALIDATION ONLY OF THE ACTS THAT COULD
NOT BE CONFIRMED/AFFIRMED, etc.
IN OTHER WORDS: if the appeal is granted, some parts of the proceeding
will be nevertheless affirmed, and only those parts that are strictly
invalid will be invalidated.
In other words: The appeal does not invalidate all the previous
procedural acts. The appeal invalidates only procedural acts that are
strictly invalid.
In other words: For the sake of judicial economy, the appeal
invalidates the invalid part of the proceeding and affirms the valid
ones.
In other words: If one part of the proceeding is declared invalid on
appeal, that will not affect otherwise valid parts of the proceeding.

só que apllicada ao recurso, e não a contrato.
